Resumen
This research aimed to analyze the need to strengthen the labor inspection system and its
relationship with the right to unionization. A qualitative approach was adopted, using documentary
observation as the data collection technique and documentary observation sheets to examine
representative cases of companies. Legal provisions, official reports, and academic literature were
reviewed to understand the interaction between unionization, working conditions, and the
effectiveness of the inspection system. The findings show that organizations with union presence
tend to offer better working conditions than those without worker representation. However,
significant limitations were identified in the capacity and effectiveness of labor inspection, which
forces unions to take a more active role in defending labor rights. These results highlight the urgent
need to strengthen the inspection system through adequate resources and stronger oversight to
ensure the effective protection of trade union and labor rights. It is concluded that a reinforced
inspection system, complemented by union action, is essential to promote fairer and more equitable
working environments.
